Please read these Terms and Conditions carefully before using the website at heirwelln.blog or engaging with any service offered by Heirwell. By accessing our website or booking one of our programmes, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
1. Definitions
- "Heirwell", "we", "us", "our" — refers to Heirwell, operating at 64 Thanon Talat Mai, Talat, Mueang, Surat Thani 84000, Thailand.
- "Services" — the organisational, educational, and facilitative programmes offered by Heirwell, including Legacy Records Orientation, Legacy Conversation Facilitation, and the Family Archive Programme.
- "User", "you", "your" — any individual who accesses our website or engages with our services.
- "Content" — all text, images, documents, materials, and information published on our website or shared during service delivery.
- "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy.
2. Acceptance of Terms
By submitting an enquiry, booking a programme, or otherwise using our services, you confirm that:
- You are at least 18 years of age, or have the consent of a parent or guardian.
- You have the legal capacity to enter into a binding agreement.
- You have read and understood these Terms and Conditions.
3. Description of Services
Heirwell provides strictly organisational, educational, and facilitative services to families wishing to gather, structure, and discuss their personal records and intentions. Our three programmes are:
- Legacy Records Orientation (฿3,900): A half-day educational session on organising family documents, photographs, and important records. No binding documents are created.
- Legacy Conversation Facilitation (฿18,500): A facilitated family conversation to discuss wishes and intentions in a neutral, supportive setting. Qualified professionals are recommended for any formal steps.
- Family Archive Programme (฿36,000): A multi-week comprehensive programme to assemble and maintain family records and intentions, with guidance on where qualified professionals should be involved. Optional annual maintenance available.
Heirwell does not draft legally binding documents, does not provide legal, financial, or medical advice, and is not a substitute for qualified legal, financial, or other professional counsel. We always recommend involving appropriate licensed professionals where the situation requires it.
4. User Responsibilities
When using our website or services, you agree to:
- Provide accurate and complete information when making an enquiry or booking.
- Treat our staff and facilitators with courtesy and respect.
- Not use our website or services for any unlawful or unauthorised purpose.
- Not attempt to reproduce, distribute, or commercially exploit our materials without written permission.
- Not misrepresent the nature of our services to others.
5. Intellectual Property
All content on this website — including written materials, methodologies, programme structures, and design — is the intellectual property of Heirwell unless otherwise stated. You are granted a limited, non-exclusive, non-transferable licence to access and use our website content for personal, non-commercial purposes only.
You may not copy, reproduce, republish, upload, post, transmit, or distribute our content in any form without prior written consent from Heirwell.
6. Payment Terms
- Currency: All prices are quoted in Thai Baht (฿) and are inclusive of applicable taxes unless stated otherwise.
- Booking confirmation: A programme is considered confirmed upon receipt of payment or a written agreement from Heirwell.
- Cancellation and rescheduling: We ask for at least 48 hours' notice for cancellations or date changes. Cancellations with fewer than 48 hours' notice may be subject to a partial fee. We will work with you to find an arrangement that is fair to both parties.
- Refunds: Where a session has not commenced and reasonable notice has been given, we will discuss a suitable arrangement. Refunds are considered on a case-by-case basis.
7. Confidentiality
We treat all information shared during sessions with the utmost discretion. Heirwell staff do not disclose personal, family, or financial details shared in the course of a programme to any third party, except where required by Thai law. We ask that participants extend the same courtesy to other family members involved in sessions.
8. Disclaimers
Our services are provided in good faith and with care. However:
- Heirwell does not provide legal, financial, tax, or professional advice of any kind. Nothing discussed or produced during our programmes constitutes legal or financial counsel.
- The outcomes of family conversations and record-organisation activities depend on the participation and decisions of individuals involved; we cannot ensure particular outcomes.
- Website content is provided for general informational and educational purposes only.
9. Limitation of Liability
To the extent permitted by Thai law, Heirwell shall not be liable for:
- Any indirect, consequential, or incidental loss arising from your use of our services or website.
- Decisions made by you or your family members based on programme content.
- Interruptions to website availability due to technical issues beyond our reasonable control.
Our aggregate liability for any claim arising from a specific programme engagement shall not exceed the fee paid for that engagement.
10. Indemnification
You agree to indemnify and hold Heirwell, its staff, and associates harmless from any claims, losses, or expenses — including reasonable costs — arising from your misuse of our services or website, your breach of these Terms, or any false or misleading information you provide to us.
11. Termination
Either party may withdraw from a programme engagement by giving written notice. Heirwell reserves the right to decline or discontinue a service engagement where:
- The request falls outside the scope of our organisational and educational remit.
- Conduct from participants is disrespectful or disruptive.
- We have reasonable grounds to believe the engagement is not appropriate.
Clauses relating to confidentiality, intellectual property, and limitation of liability survive any termination of this Agreement.
12. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally shall be subject to the jurisdiction of the competent courts of Surat Thani Province, Thailand.
13. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the full agreement between you and Heirwell regarding use of this website and our services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- No Waiver: Our failure to enforce any provision of these Terms on one occasion does not waive our right to enforce it on another.
- Assignment: You may not assign your rights under these Terms without our prior written consent. Heirwell may assign its rights in connection with a business transfer.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or applicable law. When we do, we will revise the "Last Updated" date at the top of this page. We encourage you to review these Terms periodically. Continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
